Terms of Service

1. Acceptance of Terms
By accessing or using ScentShield AI (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Service Description
ScentShield is a software platform that provides automated regulatory guidance for fragrance formulas. The Service checks formulas against IFRA Standards, EU CLP Regulation 1272/2008, REACH Regulation 1907/2006, EU Cosmetic Regulation 1223/2009, and equivalent regulations in other supported markets.
3. Regulatory Disclaimer (Important)
ScentShield provides regulatory guidance only. Results do not constitute legal or regulatory advice and do not replace assessment by a qualified Safety Assessor or Responsible Person under EU Regulation 1223/2009. Users are solely responsible for ensuring regulatory compliance of their products.
You acknowledge that:
- Compliance results are based on automated checks against our ingredient database, which may be incomplete or out of date.
- Final compliance decisions must be made by a qualified Responsible Person who has reviewed the full product context.
- ScentShield does not warrant that products checked by the Service will be approved by any regulatory authority.
- Generated documents (SDS, labels, PCN submissions) are working drafts that must be reviewed and approved by a qualified person before use.
4. Your Data and Formulas
You own your formulas. Formula data you upload to ScentShield remains your intellectual property. We process it solely to provide the Service to you.
We will never:
- Share your formulas with other tenants or third parties
- Use your formulas to train AI models
- Sell your formula data
- Disclose your formulas without your explicit consent or legal compulsion
You may export or delete your data at any time via the Settings page or by emailing support@scentshield.io. Account deletion removes all your formulas, documents, and personal data within 30 days.
5. Subscription and Billing
Paid subscriptions are billed monthly in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.
Free trial: 14 days, limited to 3 formulas and 2 markets (EU and UK). Document downloads are not available on the free trial.
6. Limitation of Liability
To the fullest extent permitted by law, ScentShield AI Limited and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
Without limiting the foregoing, ScentShield's total cumulative liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
In particular, ScentShield is not liable for any damages arising from:
- Regulatory enforcement action against your products
- Product recalls or market withdrawal
- Health or safety incidents involving your products
- Errors or omissions in the regulatory database
- Reliance on automated compliance results without independent verification
Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.
7. Acceptable Use
You agree not to: (a) reverse engineer or attempt to extract our ingredient database; (b) use the Service to create a competing product; (c) submit false or misleading data; (d) interfere with or disrupt the Service; (e) use the Service for any unlawful purpose.
8. Termination
We may suspend or terminate your account if you violate these Terms, fail to pay, or use the Service in a way that risks regulatory or security harm. You may close your account at any time.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be notified by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
